Reflections on the Effectiveness of Emergency Protective Measures

Abstract

Law 11.340/2006, better known as the Maria da Penha Law, is a fundamental piece of legislation for the protection of the rights of women who are victims of domestic and family violence. One of the main instruments of this law are the urgent protective measures, which may be granted by the judge in cases of imminent risk to the physical, psychological or patrimonial integrity of the victim. However, the effectiveness of these measures is still a challenge, considering the increase in the number of cases of domestic and family violence against women, even with the imposition of the measures. In this context, this article aims to analyze the effectiveness of urgent protective measures, identifying their main limitations and challenges in practice. For this, a bibliographic survey will be carried out that will provide an overview of the aforementioned law and the urgent protective measures. In addition, elements that aim to ensure the effectiveness of these measures will be presented, demonstrating their importance in guaranteeing the physical and psychological integrity of victims of domestic and family violence. Finally, the article will present proposals to improve the effectiveness of urgent protective measures, such as the need to expand the service network and raise society's awareness of the seriousness of gender violence.
