The new climate disputes (and the human rights discourse)

Abstract

The impact of climate change on the environment and on human beings threatens a wide range of fundamental rights protected both nationally and internationally. Climate litigation is just another tool to force climate action and repair damage. In recent times, there has been a tendency to add a climate narrative of human rights violations. The aim of this article is to explore the advantages and disadvantages of this approach and to analyze the most significant jurisprudence in this matter in order to reflect if this is the best way.
