Os Novos litígios climáticos (e o discurso dos Direitos Humanos)
Resumo
O impacto das alterações climáticas no ambiente e no ser humano põe em causa um vasto leque de direitos fundamentais protegidos tanto nacional como internacionalmente. A litigância climática é mais um instrumento para forçar a acção climática e a reparação de danos. Nos últimos tempos, observa-se uma tendência para acrescentar uma narrativa climática de violação de Direitos Humanos. Neste artigo procura-se, assim, explorar as vantagens e desvantagens desta abordagem e analisar a jurisprudência mais significativa nesta matéria para reflectir se este é o melhor caminho.
