The criminal figure of asset laundering in the Peruvian legal-criminal system

Abstract

After a review of the legislative evolution of the crime of money laundering, the author, from a hermeneutical perspective based on the theories of norms and a correct application of the dogmatic category of "autonomy" and the discarding of the "theory of not punishable fact â€, affirms that the criminalization and punishment of the self-laundering of assets dates from November 8, 1991 (date of the first anti-money laundering criminal law, Legislative Decree No. 736), since this is simply a form of commission of the punishable act of money laundering.
